Terms of Service
1. About These Terms
By booking a party, making a payment, or using the Painted Sweet LLC website (paintedsweet.com), you agree to these Terms of Service. These terms constitute a binding agreement between you ("Client") and Painted Sweet LLC, a California limited liability company ("Painted Sweet," "we," "us").
2. Services
Painted Sweet LLC provides mobile art party experiences, including canvas painting, ceramics, tie-dye, and other creative activities, at locations designated by the Client within our service area. Services are delivered on the date, time, and at the address that was confirmed when the event was scheduled.
3. Booking & Payment
- A non-refundable $50 deposit is required at the time of booking to reserve your event date and time. Your date is not confirmed until the deposit is received.
- The remaining balance is due prior to the date and time of your event by paying through the website, cash, or check.
- Online deposit and event payments are processed securely through Square, Inc. Painted Sweet does not store your payment card information.
- All prices are listed in U.S. Dollars (USD) and are subject to change with prior notice. Prices quoted at booking are honored for that booking.
- Travel fees may apply for locations outside Tulare County. Any applicable travel fee will be disclosed prior to booking confirmation.
4. Cancellation & Rescheduling Policy
- The $50 deposit is non-refundable under all circumstances, including cancellation by the Client.
- If you need to reschedule, please notify us at least 7 days before your event. Rescheduling is subject to availability and the deposit may be applied to one alternative date at our discretion.
- Cancellations made with less than 7 days' notice may result in forfeiture of the deposit without the option to reschedule.
- In the unlikely event that Painted Sweet must cancel due to illness, emergency, or circumstances beyond our control, we will offer a full refund of the deposit or reschedule at no additional charge.
5. Guest Count
Each package has a maximum guest count included in the price. Additional guests beyond the included count may be accommodated for an additional per-guest fee, disclosed at booking. Final guest counts should be confirmed at least 48 hours before your event.
6. Client Responsibilities
- Client is responsible for providing a suitable, safe, and accessible space for the art party with adequate table and seating space for all participants.
- Client agrees to supervise all minor guests throughout the event. Painted Sweet staff are instructors only and are not licensed for child care. This is a recreational art activity, not a drop-off child-care service, and a parent or guardian must remain present and responsible for the children at all times.
- If you are booking on behalf of one or more minor children, you represent that you are the parent or legal guardian (or an adult authorized by the parent or legal guardian) of those children and that you are at least 18 years old and entering into these Terms on their behalf.
- Client assumes responsibility for any damage to the event space caused by participants during the art activity.
- Please notify us of any allergies or sensitivities prior to the event so we can do our best to accommodate.
7. Photography & Media
Painted Sweet may photograph or video the event for marketing purposes (social media, website, promotional materials), but only with your consent. This is strictly opt-in: we will use photos or video of your event for marketing only if you check the photo & marketing consent box when you book. If you do not opt in, we will not use images of your event for marketing. Any permitted photography and marketing use is without compensation to you. You may grant or withdraw your consent at any time by contacting us in writing; a withdrawal applies to future use and may not reach materials already published.
8. Assumption of Risk, Release & Limitation of Liability
Assumption of risk. Art and craft activities involve inherent risks, including the use of paint, dyes, tools, and other materials that may stain or cause minor injury, as well as the ordinary risks of an in-person gathering. By booking and participating, the Client — and, where the Client is a parent or legal guardian, on behalf of the minor children in their care — knowingly and voluntarily assumes these risks.
Release. To the fullest extent permitted by California law, the Client releases and agrees to hold harmless Painted Sweet LLC and its staff from any claims, demands, or damages — including those arising from the ordinary negligence of Painted Sweet — relating to injuries to participants, misuse of art supplies, accidents caused by participants, or damage to personal property at the event venue. As the parent or legal guardian, you agree to this release on behalf of your minor children.
Limits of this release. Nothing in these Terms releases or limits liability for gross negligence, recklessness, willful misconduct, fraud, or any other liability that cannot be waived or limited under California law. This release does not apply to childcare, because Painted Sweet does not provide childcare.
Except for liabilities that cannot be limited as described above, our total liability under these Terms shall not exceed the amount paid for the specific event giving rise to the claim, and we are not liable for indirect, consequential, or incidental damages.
9. Payment Processor Disclosure
Deposit payments are processed by Square, Inc. (squareup.com). By paying via Square, you also agree to Square's Terms of Service and Privacy Policy. Painted Sweet LLC does not receive, store, or have access to your full credit/debit card number. All card data is encrypted and handled solely by Square.
10. Privacy
Information you provide during booking (name, phone, email, event details) is used to communicate with you about your event and to send booking notifications. We do not sell your personal information for money. To process payments we use Square, and to measure website traffic and to deliver and measure our advertising we use analytics and advertising tools from Google (Google Analytics and Google Ads) and Meta (the Meta Pixel for Facebook and Instagram). These tools may collect information about your visit and recognize your device across other sites to show you relevant ads, which helps us improve our services, customer experience, and sales practices. 11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Tulare County, California.
